This Privacy Policy explains how we collect, use, disclose, and protect information about you when you visit our websites, mobile sites, emails, and other online services that link to this Privacy Policy (collectively, the "Site"), and when you purchase or interact with our products and services (collectively, the "Services").

  • Identifiers & Contact Information (e.g., name, email address, billing/shipping address, phone number, account credentials).

  • Order & Payment Information (e.g., products purchased, subscription selections, order history). Payment card details are processed by our payment processor; we do not store full card numbers.

  • Communications & Support (e.g., messages, survey responses, reviews/testimonials, UGC such as photos or videos you choose to submit or tag us in).

  • Health & Wellness Context you voluntarily share (e.g., general wellness goals or experiences). Do not share sensitive health information you do not wish us to process.

2.2 Information Collected Automatically

  • Device, Log & Usage Data (e.g., IP address, browser type, device identifiers, pages visited, time on page, referring/exit pages, crash data).

  • Cookies & Similar Technologies (e.g., cookies, pixels, tags, SDKs) used for functionality, analytics, personalization, and advertising. See Cookies & Tracking.

  • Approximate Location derived from IP address.

  • Marketing & Advertising Partners (e.g., ad networks, social media platforms, affiliate/referral partners).

  • Analytics Providers and Fraud Prevention services.

  • Retail/Marketplace Partners if you purchase SecondKind through authorized third parties (subject to their policies).

  2. Customer Support & Communications (service messages, transactional notices, and - if you opt in - marketing emails/SMS).

  5. Security & Fraud Prevention (detect, investigate, and prevent fraudulent or illegal activity and enforce our Terms).

  6. Compliance (legal obligations, recordkeeping, and to exercise or defend legal claims).

Where required by law, we rely on the following legal bases to process personal information: contract (to provide Services you request), consent (e.g., for certain cookies/marketing), legitimate interests (e.g., to improve and secure our Services), and legal obligations.

  • Text/SMS (Opt‑in only): If you opt in, you consent to receive recurring automated marketing messages at the number provided. Consent is not a condition of purchase. Message frequency varies. Msg & data rates may apply. Reply STOP to cancel, HELP for help. Mobile carriers are not liable for delayed or undelivered messages.

 


 

6. How We Share Information

We may share information as follows:

  • Service Providers & Vendors (e.g., payment processing, fulfillment, email/SMS delivery, analytics, advertising, customer support, cloud hosting) under contracts that restrict use of information to services performed for us.

  • Advertising & Analytics Partners to provide interest‑based ads, measure campaign performance, and understand usage (see Your Choices below).

  • Corporate Transactions (e.g., merger, acquisition, financing, or sale of assets) where information may be transferred as part of the transaction.

  • Legal & Safety (comply with law, respond to lawful requests, enforce our terms, protect rights, property, and safety of SecondKind, our users, or others).

  • With Your Direction or Consent (e.g., when you connect or interact with third‑party services or share UGC on social platforms).

We do not sell personal information for money. We may engage in “sale” or “sharing” for cross‑context behavioral advertising under certain U.S. state laws when we allow advertising partners to collect information via cookies/pixels. See Your Privacy Rights.

 


 

7. Your Privacy Rights & Choices

Depending on your location, you may have the right to:

  • Access your personal information and obtain a copy.

  • Correct inaccurate information.

  • Delete your information.

  • Port your information in a machine‑readable format.

  • Restrict or Object to certain processing (including targeted advertising or profiling).

  • Withdraw Consent where processing is based on consent.

How to Exercise Your Rights

Submit a request to privacy@secondkind.com with your name, email, and the nature of your request. We may verify your identity. You may also use an authorized agent where permitted by law.

U.S. State Law Disclosures (e.g., CA/VA/CO/CT/UT)

Residents of certain U.S. states have additional rights regarding sale/sharing and targeted advertising. To opt out of sale or sharing and targeted advertising, adjust cookie preferences (where available) and/or email privacy@secondkind.com with the subject “State Privacy Opt‑out.” We honor GPC signals as an opt‑out where required by law.

EEA/UK/Swiss (GDPR) Rights

Residents of the EEA/UK/Switzerland have the rights listed above and may also lodge a complaint with a supervisory authority. Our lawful bases are described in How We Use Information. Where applicable, you may object to processing based on legitimate interests.

 


 

8. Sensitive & Health‑Related Information

SecondKind is a wellness brand and may receive general wellness context that you voluntarily provide (e.g., your experience with a product). We ask you not to submit sensitive health information or data you consider confidential. Where laws such as Washington’s My Health My Data or Nevada’s Consumer Health Data laws apply, we limit collection to data reasonably necessary to provide the Services, obtain consent where required, and honor applicable rights requests.

 


 

9. Data Retention

We retain information for as long as necessary to provide the Services, comply with legal obligations (including tax and accounting), resolve disputes, and enforce agreements. Retention periods vary based on the type of data and our legal obligations.

 


 

10. Data Security

We implement administrative, technical, and physical safeguards designed to protect personal information. No security measures are perfect, and we cannot guarantee absolute security of data transmitted over the internet.

 


 

11. International Transfers

If you access the Site from outside the United States, your information may be processed in the U.S. and other countries, which may have data protection laws different from your country. Where required, we use appropriate safeguards (e.g., standard contractual clauses) for cross‑border transfers.

Our Site and Services are not directed to children under 13 (or the age defined by local law). We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

Mobile Terms of Service

The SecondKind mobile message service (the "Service") is operated by SecondKind (“SecondKind”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to SecondKind’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of SecondKind through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with SecondKind. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18667248802 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other SecondKind mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
